on port dues

GENERAL ISSUES

      1. Port dues (tonnage, canal, lighthouse, berth, anchorage, administration and sanitary dues) shall be established in the sea ports for vessels and floating objects, sailing under the state flag of Ukraine and foreign flags, namely:

  Group
      cargo vessels calling at ports for cargo operations and floating objects A
      passenger vessels including high-speed hydrofoil ships and ferries calling at a port for cargo-passenger operations, ice-breakers neither belonging to port of call nor hired by it B
      lighters, tugboats, pushing tugboats, pushers, self-propelled and non-self-propelled barges, self-propelled river-type vessels, including the river-marine ships of the Bratislava Agreement shipping companies calling at the Danube ports, as well as self-propelled river vessels calling at the other ports for further reloading of cargo on sea vessels and vice-versa C
      dumb craft (excluding barges) D
      vessels calling for refuge, supply, quarantine and other needs and vessels arriving for repairs to ship-repair yards (bases) of Ukraine; auxiliary vessels and military ships E

            Notes:
1. "Calling for refuge" means ship's entering a port when there is a threat to further safe navigation, crewmembers' and passengers' lives or health.
2. Vessels ascribed to Groups C (tugboats and barges), E and F, performing commercial cargo voyages shall belong to Group A.
3. Vessels ascribed to Groups E and F, performing commercial cargo-passenger voyages shall belong to Group B.
4. The way the dues and charges are calculated and applied shall extend to participants in business of any form of property who do some work or render services in the sea ports or on the quays of the ship-repair yards of Ukraine, no matter what administrative authority these ports (quays) may belong to.

      2. The port dues shall be paid prior to ship's departure whereas payment of dues for transit passage of the Kerch-Yenikalsky Canal and Prorva Canal shall be performed by means of pre-payment or on entering the Canals if nothing else is stipulated.

      3. Port dues and charges shall be based on the ship's conditional volume evaluated in cubic meters by multiplying the ship's three particulars (length, breadth and moulded depth) specified in the Tonnage Certificate (main dimensions) or other document substituting it.

      For sea vessels, except tweendeck ships, carrying cargo on the upper deck or which have two or more decks, the moulded depth used in the calculation shall be not less than half the vessel's breadth.

      For vessels of Group B which have two or more decks, the moulded depth used in the calculation shall be half the vessel's breadth.

      The conditional volume of pusher barge systems, convoys of vessels and other compound floating objects shall be estimated as the aggregate volume of the components for all the dues and charges, except the sanitary dues.

      The conditional volume of RO-RO, RO-FLOW, OBO, LO-RO, container ships, cattle-carriers, LASH-carriers, car carriers shall be applied with a coefficient of 0.7. The ship-s type and specialization shall be determined by using the ship-s documents. The coefficient of 0.7 shall be applied only if the abovementioned vessels are used according to their specialization.

      In cases of estimation of dues and charges per day (24 hours), the duration of rendered services shall be approximated to 12 hours, a time period of less than 12 hours being considered as 12 hours, while a time period of more than 12 hours shall be considered as 24 hours.       4. Lighter-carrying vessels performing cargo operations with lighters in outer or inner roads shall be charged for the aggregate volume of lighters discharged on arrival and loaded prior to departure from the port.

      5. For cargo vessels of group A, sailing on foreign-going lines, opened according to the established routine, tonnage dues shall be collected with a 20% discount.

      6. The main criteria for foreign-going lines are as follows:
  • fixing the obligatory and optional foreign and Ukrainian ports of call;
  • the assignment of specific types of vessels for work on the lines;
  • drawing up a schedule for the assigned vessels' calls at Ukrainian ports;
  • the registration of the line by the State Department for Merchant Marine and River Transport on presentation of port (sea port) authority.
  •       7. For vessels calling at the port of Yuzhny for loading or discharging general and bulk cargoes, the port may apply a 50% discount on all port dues.

          The following discounts shall be granted in the port of Yalta:
  • a 50% discount on tonnage dues for ships ascribed to Group A;
  • a 20% discount on all port dues for cruise passenger foreign-going vessels of Group B (excluding those performing cargo-passenger operations).
  •       In the port of Odessa a 10% discount shall be applied on all port dues for cruise passenger ocean-going vessels of Group B (except those performing cargo-passenger operations).

          8. If several discounts on port dues apply to a vessel, only the largest discount shall be applied.

          9. The state affiliation of a vessel and its corresponding status for collection of port dues shall be determined by the flag under which the vessel is sailing, independent of the affiliation of its owner or operator.

          10. Port dues shall be paid in accordance with Decree of the Cabinet of Ministers of Ukraine No. 15 (15-93) dated 19th February 1993 "On System of Currency Regulation and Control".

          11. Value added tax according to the Ukrainian legislation shall be paid on the amount of port dues, paid in the national currency. At that, the amount of dues, determined by the present regulations, for services rendered to vessels on coastal voyages, shall be increased by the amount of value added tax; in other cases the amount of VAT payable to the budget shall be calculated proceeding from the amount of dues collected in port without such increase.

    TONNAGE DUES

          12. Tonnage dues from vessels of groups A, B and D shall be collected for each inward and outward passage. Per 1 cu m according to the following rates:

          Note:
      Vessels calling at ports for performance of clearance operation through the Ukrainian State border without performing cargo operations, shall be exempted from payment of Tonnage dues.

          13. Vessels of Groups E and F shall be exempted from tonnage dues.
          For foreign-going vessels of Groups A, B, D with a conditional volume of up to 10,000 cu m the rate of the tonnage dues shall be applied with a coefficient of 0.8. (Article 13 corrected as per The Cabinet of Ministers of Ukraine Decree #1069 (1069-2003-ï) dated 17.07.2003)

          14. The rates of the tonnage dues for foreign-going vessels shall be applied irrespective of the flag under which they are sailing. (First paragraph of Article 14 corrected as per The Cabinet of Ministers of Ukraine Decree #1069 (1069-2003-ï) dated 17.07.2003)
          Tonnage dues rates for vessels on coastal voyages shall only be applied to vessels, sailing on coastal voyages under the Ukrainian flag.
          When the maximum draft of big ships stated in Tonnage Certificate exceeds ship-s allowable draft in port of call which results in less cargo loaded, in tonnage dues calculation the port is entitled to decrease ship-s moulded depth by the value equal to draft not used.

          15. If, during the same voyage, a vessel of Group A calls successively at several Ukrainian ports tonnage dues shall be paid as follows:
      · if the vessel calls at two ports - with a 50% discount on the rate in each port of call;
      · if the vessel calls at more than two ports - with a 50% discount in the first port and with a 75% discount in each subsequent port.
          16. Tonnage Dues on vessels of group B shall be charged for inward and outward passages at each port of call at rates with 50% discount only for the first and second voyage during one calendar year. During the following calls at port performed during the same calendar year, tonnage dues shall not be collected.

          17. For vessels of Group C dues shall be collected for ship's each entering and leaving the port according to the following rates:
      for vessels on the foreign-going voyages:

    • USD 40.50 - per vessel, tug;
    • USD 20.25 - per unit (barge, lighter).

      for vessels on coastal voyages:

    • USD 10.00 - per vessel, tug;
    • USD 5.00 - per unit (barge, lighter).

    CANAL DUES

          18. Canal dues shall be collected for each passage of the canal by the vessel and each transit passage of the canal per 1 cu m of the vessel's volume according to the following rates:

          Notes:
            1. The rate related to the berths of the "Okean" works shall only be applied to vessels proceeding along the Bugsko-Dneprovsky canal to the berths of the works for discharging or loading.
            2. Vessels passing along the Bugsko-Dneprovsky canal and the Kherson sea canal without calling at the sea ports (berths) shall pay the canal dues according to the rates to the "Delta-Pilot" state enterprise and to the sea trading ports of Nikolaev and Kherson respectively in the amounts fixed for the port of Nikolaev (sea port) and the port of Kherson (sea port).
            3. For vessels whose draft according to Tonnage Certificate does not exceed 4.5 m when fully loaded, the rate of canal dues shall be applied with a coefficient of 0.38 except the Belgorod-Dnestrovsky port, the Prorva canal, the approaching canal of the "Azovstal" works.
            4. For vessels passing along the approaching canal of the "Azovstal" works the rate of canal dues shall be applied with a coefficient of 0.5.

          19. Vessels of group B shall be charged for inward and outward passages at each port of call according to half rates 50% only for the first and second voyage during one calendar year. For subsequent passages during the same calendar year canal dues shall not be collected.

          20. Vessels of groups C, E and F and vessels of group D (except barges) passing through the Prorva canal shall be exempted from payment of canal dues.

    LIGHTHOUSE DUES

          21. Lighthouse dues from vessels of groups A and B shall be collected during each call at port (plant/yard) or for each passage as transit at the following rates:
    • USD 0.029 per 1 cu m of vessel's volume- from foreign-going vessels;
    • USD 0.0029 per 1 cu m of vessel's volume - from vessels in coastal voyages.
          Full rate of Lighthouse Dues shall be paid directly to the governmental organization "Derzhgidrografiya". (Article 21 corrected as per The Cabinet of Ministers of Ukraine Decree #391 (391-2002-ï) dated 29.03.2002)

          22. Vessels of groups C, D, E and F shall be exempted from payment of light dues.

    BERTH DUES

          23. Berth dues shall be collected from vessels actually made fast to a wharf.

          24. For vessels of Groups A, B, C (tugboats), D, E and F (racing boats, private yachts, sailing and fishing ship calling at ports without cargo-handling operations) the following rates shall be applied:

          Note:
      Vessels of group F (except racing boats, private yachts, sailing and fishing ships calling at port without cargo-handling operations) shall be exempted from payment of berth dues.
          25. Vessels of group C (except tugboats) shall be charged for each ton of loaded or discharged cargo according to the following rates:
    • USD 0.12 - for foreign-going vessels;
    • USD 0.012 - for vessels in coastal voyages.
          Payment shall be performed for each operation separately. A 50% rebate shall be granted in cases when cargo is handled at an unequipped shore/bank or transshipped from one vessel to another.

          26. A 50% rebate shall be granted to vessels lying alongside other vessels already made fast to a wharf, or made fast to a wharf either bow or stern to.

          27. Vessels of groups A and B after the completion of cargo (passenger) operations shall be charged for occupying a loading (passenger) wharf for reasons lying with the vessel or its owner and beginning from the moment of completion of discharging or loading and lashing of the cargo at the following rate per 1 cu m:
    • USD 0.0104 per hour - from foreign-going vessels;
    • USD 0.00104 per hour - from vessels in coastal voyages.
          28. At the Shipmaster's or Shipowner's request the Port administration shall allot a vacant wharf or anchorage place for the purpose of anticipating or completing service operations to the vessel.

    ANCHORAGE DUES

          29. Anchorage dues for riding at anchor in the inner roads of a sea port over 12 hours, shall be levied on vessels of Groups A, B at the following daily rates per cu m for the actual period of anchorage:
    • USD 0.0027 - from foreign-going vessels;
    • USD 0.00027- from vessels in coastal voyages.
          30. Anchorage dues on vessels of group C, D and F (racing boats, private yachts, sailing and fishing ships calling at a port without cargo operations) shall be charged at the following rates for a 30-day stay in inner roads:
    • USD 18.00 - from foreign-going vessels;
    • USD 1.80 - from vessels in coastal voyages.
          For each additional day of stay in inner roads exceeding the said period anchorage dues shall be charged at the following rates:
    • USD 2 - from foreign-going vessels;
    • USD 1 - from vessels in coastal voyages.
          31. Vessels of groups E and F (except racing boats, private yachts, sailing and fishing ships calling at a port without cargo operations) shall be exempted from payment of anchorage dues.

    ADMINISTRATION DUES

          32. Administration dues from vessels of groups A, B, C, D shall be collected for each inward passage according to the following rates:
      USD 0.014 per 1 cu m of vessel's volume - from foreign-going vessels;
      USD 0.0014 per 1 cu m of vessel's volume - from vessels in coastal voyages.
          Vessels calling for clearance formalities (without cargo operations) shall be exempted from Administration dues.

          Vessels of groups A, B, C and D which, during the same voyage, call successively at several Ukrainian ports for cargo operations shall pay administration dues only in the first port of call.

          Discounts granted by the ports as per agreements with the Shipowners shall not extend to Administration dues.

          33. Vessels of groups E, F shall be exempted from Administration dues.

          34. Administration Dues collected by ports shall be used according to law.

    SANITARY CHARGE

          35. Collection of the sanitary charge shall provide for the following obligations:

          - obligation of the Port to remove all kinds of polluted materials (except ballast waters) from a vessel during the period of its call at port, as well as to perform all operations connected with removal (craft-yard services, assignment of containers and other capacities for garbage, transshipment operations, hosing/unhosing operations, etc.) at its own account and workforce;

          - obligation of the vessel to present for removal all kinds of polluted materials so as to prevent their disposal into the sea. The removal of polluted materials shall be accordingly certified by the Port.

          36. Vessels of group A shall be charged as per 1 cu m of the volume of the vessel or the self-propelled component of a compound object at the following rates:

          Notes:
            1. Vessels of Groups B, C, D, E and F shall be exempted from payment of sanitary dues.
            2. In ports, not equipped with reception facilities, collection of sanitary dues shall not be performed.

            37. A 50% rebate on Sanitary Dues shall be granted to vessels which are equipped with environment protection equipment for full utilization of all kinds of ship's wastes and polluted materials and which have an International Certificate on the prevention of pollution of the sea with oil, sewage water and a Certificate on the prevention of pollution with garbage (environmentally clean).

            38. In cases when sanitary dues are not charged, the routine of collecting payment for reception of polluted materials shall be established by the Ministry for Transport of Ukraine.
